Investigation Continues Into Crash On I-94 That Kills Woman Expecting First Child
Posted By Freedman & Freedman

Michigan State Police are continuing to investigate a recent crash on I-94 that killed a woman expecting her first child.

What caused a tractor-trailer to strike the van carrying Sara Cole, whose baby briefly survived but tragically died three (3) short days later, is part of the inquiry, state police reported.  A crash reconstruction specialist is involved in the investigation.  Once the investigation of the  car accident is completed, the prosecutor's office will review the work of the officers and make a determination about any possible criminal charges.

It was reported by state police that Cole, 35, and her husband, Chad, were traveling west near Dearing Road in Sandstone Township when a semitrailer truck struck the back of the van. They were in the back seat of the van, driven by Sara Cole's father, Clarence Fisher, 65.

Her father had apparently pulled the van to the side of the road in order to avoid vehicles losing control in front of them and with snow falling, visibility was limited and vehicles had already reportedly crashed ahead of them.

Cousin Of Professional Basketball Player, Willie Green, Dies In Drunk Driving Accident
Posted By Freedman & Freedman

The driver in a crash Monday that killed both him and his cousin, the sister of pro basketball player, Willie Green, apparently had a blood-alcohol level that was three times the legal limit, police said Tuesday.

Gary Benjamin Green, 27, and his cousin, Tamara Lynette Green, 30, were killed while returning to their Detroit home about 12:40 a.m. after watching Willie Green and the New Orleans Hornets play the Detroit Pistons at The Palace of Auburn Hills. Willie Green, a former player at the University of Detroit Mercy, is Tamara Green's brother and Ben Green's cousin.

According to police, witnesses and an investigation showed Ben Green was driving fast in a GMC Envoy south on I-75 when he apparently lost control of the vehicle south of Adams Road and went off the shoulder. The SUV rolled over into a tree.

Ben Green, who was not wearing a seat belt, was found to have a blood-alcohol level of 0.24 - three times the .08 level at which a driver is considered intoxicated under Michigan law.

It is being reported that, in addition to this drunk driving accident, Ben Green had a lengthy driving record, according to state records, with at least two drinking and driving violations. According to police, his driver's license was suspended at the time of the crash.

Jury Picked In Wrongful Death Case
Posted By Freedman & Freedman

A federal jury in Detroit has been picked in the wrongful death lawsuit arising out of a 2005 incident that destroyed the Weinstein family.  Judith Weinstein was driving to a medical appointment with her two sons, Alex, 12, and Sam, 9.  Alex was in the front seat and Sam was seated in the back.  As Mrs. Weinstein entered a left-turn lane on 12 Mile Road, east of Orchard Lake Road, Thomas Wellinger crashed his SUV into the rear of the Weinstein vehicle at 70 mph, pushing it into oncoming traffic.  Judith Weinstein and Alex Weinstein were pronounced dead at the scene of the crash.  Sam was ejected from the vehicle and died a short time later.

Gary Weinstein has filed suit against Livonia-based UGS Inc., the employer of Wellinger at the time.  The lawsuit alleges that UGS Inc. was negligent in allowing Wellinger to leave the office visibly intoxicated.  Wellinger allegedly left his place of employment 45 minutes prior to the crash to see a psychiatrist about his alcoholism.  At the time he crashed into the Weinsteins, Wellinger had a blood-alcohol level of 0.43.

Testimony began Tuesday in the criminal trial of Leonel Franco-Avina for the death of 30-year-old Aaron Haynes last November 23rd.  Franco-Avina allegedly had a blood alcohol content of 0.425 when he drove the wrong way on the northbound lanes of East Beltline Avenue and hit Haynes head-on.  At the time of thecar accident, Franco-Avina's alleged blood alcohol was more than 4 times the legal limit prompting the prosecutor's argument that Franco-Avina be convicted second-degree murder, not drunken driving causing death.
