  $49,000 Settlement In Trip And Fall Case

It is being reported that in July 2007, Margaret Malinasky of Royal Oak was carrying her infant granddaughter while walking along a residential sidewalk when she tripped on a raised portion of the sidewalk.   The incident reportedly caused her to break two toes and displace others.   Ms. Malinasky later filed a lawsuit against the city of Royal Oak claiming that the city was negligent in its maintenance of the sidewalk.   While the severity of her injuries and resultant impact on her life is unknown, a case evaluation panel valued the claim at $83,000.   The city did not pay her that amount, however, it is being reported that the city of Royal Oak has agreed to pay her approximately $49,000 to settle the case and avoid the necessity of going to trial without admitting fault.

  Monroe County Crash Kills 3

Sarah Prochaska-Carpenter of Blissfield was driving east on US-223 in Whitefield Township when she lost control of her 2003 Ford F-250 pick-up truck.   She then struck a 1988 Jeep pickup truck driven west on US-223 by Alan Gies of Temperance.   Both Prochaska-Carpenter and Gies died at the scene of the accident.   Tyler Baldwin, 19, a passenger in Gies truck, was taken to Toledo Hospital where he lost his life.   Police are continuing to investigate the accident.

  A Woman’s Attempt To Pass A Slower Vehicle Results In Injuries

A three car crash occurred in Volina Township Friday injuring two people.  At approximately 9:15 a.m., Fannie Mitchell, 71, attempted to pass another vehicle without ascertaining whether it was safe to do so.  She reportedly did not see the oncoming vehicle being driven by Ashley Stacks, 22, and the two cars crashed into one another.  The vehicle following Ms. Stacks, driven by Jessica Kelley, 19, also struck Ms. Stacks.  Both Ms. Mitchell and Ms. Stacks were taken to the hospital with injuries.  There is no report of injury to Ms. Kelley.

  Man Dies In Car Crash In Ionia County

A 30-year-old woman from Grand Ledge was driving northbound on Keefer Highway Thursday night when she spun across the center line into oncoming traffic.  An oncoming car slammed into her vehicle on the passenger side killing her passenger Scott Schafer, 40, from Portland .  The female driver was also injured and was taken to Lansing’s Sparrow Hospital .  The driver of the second car refused medical care.

  Car Crash On I-75 Kills 1, Injures 3

A man from Ohio was killed this morning when the car he was driving hit another vehicle that was stopped in the center lane of I-75, north of West Road in Woodhaven.  It is being reported that the vehicle first hit the guard wall before coming to rest in the center lane.  The driver of that vehicle was taken to the hospital.  The Ohio man had two passengers riding with him, a male and a female.  They were also taken to the hospital.  The extent of their injuries has not been reported.  The Michigan State Police are investigating the crash.

  First Snow Fall Of The Season Brings Tragedy

An 18-year-old woman lost her life Friday. She didn’t have to. Brittany Marie Nowicki was a passenger in a Jeep that was being driven by an 18-year-old man. The snow was falling creating a need for caution by the early morning drivers. As the driver of the Jeep was traveling eastbound on Plum Brook Drive just east of Schoenherr around 5:30 a.m., he came upon a slower vehicle. The driver of the Jeep tried to pass the slower vehicle in snowy conditions and lost control and hit a westbound vehicle. The crash caused the Jeep to roll over and Brittany was ejected. She was pronounced dead at the scene. The driver of the Jeep is in critical condition at Henry Ford Macomb Hospital. The driver of the vehicle hit by the Jeep was injured but the extent of his injuries remains unknown.

  Passenger Dies In Crash Outside Of Faygo Plant

Just after 6:00 this morning, a man driving a minivan crashed into a truck leaving the Faygo Beverages plant on Gratiot just south of Mt. Elliott on Detroit's east side.  His female passenger was killed.  The driver of the minivan was hospitalized but the extent of his injuries remains unknown.  The driver of the truck was not seriously injured.

  Jury Picked In Wrongful Death Case

A federal jury in Detroit has been picked in the wrongful death lawsuit arising out of a 2005 incident that destroyed the Weinstein family.  Judith Weinstein was driving to a medical appointment with her two sons, Alex, 12, and Sam, 9.  Alex was in the front seat and Sam was seated in the back.  As Mrs. Weinstein entered a left-turn lane on 12 Mile Road, east of Orchard Lake Road, Thomas Wellinger crashed his SUV into the rear of the Weinstein vehicle at 70 mph, pushing it into oncoming traffic.  Judith Weinstein and Alex Weinstein were pronounced dead at the scene of the crash.  Sam was ejected from the vehicle and died a short time later.

 

Gary Weinstein has filed suit against Livonia-based UGS Inc., the employer of Wellinger at the time.  The lawsuit alleges that UGS Inc. was negligent in allowing Wellinger to leave the office visibly intoxicated.  Wellinger allegedly left his place of employment 45 minutes prior to the crash to see a psychiatrist about his alcoholism.  At the time he crashed into the Weinsteins, Wellinger had a blood-alcohol level of 0.43.

  22-Year-Old Killed In Tractor-Minivan Crash

On Sunday morning, Russell Roszczewski was riding a farm tractor west on Shaw Road, east of Brown City Road near Imlay City when a 2002 Chevy Venture traveling in the same direction attempted to pass him on the left.  Tragically, Roszczewski was making a left turn into his driveway at the same time and the minivan smashed into the farm tractor.  Roszczewski was pronounced dead at the scene.  The driver of the minivan was not injured.

  Holiday Turns To Tragedy When College Student Is Killed In Accident

Juliana Karmann, a freshman pre-med student at Denison University in Ohio, was driving home last Friday evening for the Thanksgiving holiday along with three other students.  She never made it home.  Juliana was traveling west on the Ohio 15 when her 2004 Chevrolet SUV hit the rear end of a 2001 Freightliner tractor-trailer.  It was not her fault.  It is being reported that the driver of the Freightliner, a Detroit man, stopped at a stop sign on southbound Township Highway 95 and then tried to cross the westbound lane, without the right of way, and go east on Ohio 15.  Police say Karmann had the right of way.  The Freightliner driver failed to yield.  When Karmann struck the tractor-trailer, she spun out and slid across the eastbound lanes of Ohio 15 where she struck a 2009 Chrysler carrying two passengers.  Juliana was dead at the scene of the crash.  One of her passengers continues to recover from his injuries

 

The driver of the tractor-trailer was charged with negligent homicide and failure to yield.  He was taken to Wyandot County Jail in Ohio.

  2 Toledo Women Injured In Rollover Crash

Two women were injured on southbound US.23 just south of US-12 in Pittsfield Township when the car they were in rolled over and came to a rest on the edge of northbound US-23.  No other vehicles were involved.  Both northbound and southbound lanes of US-23 were closed for nearly an hour as a result.  The driver claims that the accident occurred because she was cut off by another car.  Firefighters had to cut the driver out of the car in order to free her and both women were taken to St. Joseph Mercy Hospital for treatment.

  Woman Dies From Injuries Sustained When She Was Hit By Forklift

Sharon Welling, an employee at Isabella County Recycling Center, was hit by a forklift Monday while she was at work.  A 52-year-old man from Alma was driving the forklift at the time of the accident.  He was transporting a large recycling bin when he hit her.  Welling sustained serious injuries to her leg and pelvis and was airlifted to Hurley Medical Center in Flint.  Unfortunately, Ms. Welling died yesterday morning from her injuries.

  Accident Victim Upgraded to Good Condition

Cindy Perrine was driving south on Lansing Avenue in Jackson around 8:00 a.m. on Thursday when a northbound Cadillac, driven by Donald Seitz, 73, which was turning left into a manufactured housing community, hit her car.  Perrine’s car was hit in the driver-side corner causing her to be trapped inside the car.  She was taken by helicopter to the University of Michigan Medical Center in Ann Arbor in serious condition but was later upgraded to good condition.  It is being reported that Perrine had a head and leg injury.

  Tougher Sanctions For Vicious Dog Owners

On Monday, Rochester Hills City Council directed staff members to draft an amendment to the city ordinance that would impose stronger punishment upon dog owners whose dogs injure people or other animals.  City Council President Greg Hooper reportedly indicated that the amendment to the ordinance would not be breed specific but would rather focus on making dog owners more responsible.     According to the Oakland Press, Councilman James Rosen stated that “we have to make the consequences of aggressive dog behavior so onerous…I mean major-league financial penalties and even incarceration.”

  Dog Owners Charged In Pit Bull Attacks

Wayne County Prosecutor Kym Worthy announced that 3 pit bull owners are being charged with felonies for failing to control a dangerous animal that caused serious injury.  The charges arise out of 3 separate attacks by 4 pit bulls, one in Westland and two in Dearborn Heights , within the last 2 months.  The 39-year-old victim of the Westland attack reportedly suffered wounds requiring more than 50 sutures.  The first attack in Dearborn Heights resulted in face, jaw and arm wounds for the 51-year-old victim.  In the last Dearborn Heights attack, both a 10-year-old girl and her 75-year-old rescuer suffered bites requiring 14-15 stitches each.

  Prosecutor To Announce Charges In Pit Bull Attacks

The Free Press is reporting that Wayne County Prosecutor Kym Worthy has scheduled a news conference for 2:30 p.m. today to announce whether charges will be issued in three recent pit bull attacks.  Two of the attacks occurred in Dearborn Heights and one occurred in Westland .  All of the attacks involved different dogs.

 

In all three attacks, the victims suffered serious injuries.  In the September 23 attack, P.J. Stevens, a 51-year-old woman, suffered punctures to the hand and thigh, a ripped ear, injuries to the back of her head and right arm as well as scrapes to her body when the dogs dragged her on the sidewalk.  In another attack in Dearborn Heights on September 25th, a 10-year-old girl suffered 14 stitches in her arm while her rescuer, Gerald LaMonica, who kicked the dog to get it away from the girl, suffered 15 stitches in the leg.  The Westland attack on a woman in August resulted in the police shooting and killing the dog.

  Pit Bull Attack Leaves Young Victim On Long Road To Recovery

Six-year-olds should be living care-free lives full of friends, school and play.  For Tyah Norris, her life is one of pain and recovery. 

 

On August 24th little Tyah was viciously attacked by 3 pit bulls.  The focus of the attack was to Tyah’s face and head.  When Blackman Township Public Safety Officer Randy Hengesbaugh arrived on the scene, he didn’t think an ambulance would come quickly enough to save her life.  Against protocol, he took Tyah to Allegiance Health himself.  The family believes he saved her live.

 

Tyah was ultimately taken to the Mott Children’s Hospital in Ann Arbor where she was hospitalized for nearly 3 weeks.  She had surgery to repair damage to her eyes, nose and other features.  Since her release, she must return to the hospital on a weekly basis for further treatment.  Her family says that at night, Tyah has to wear tubes in her nose to keep her airways open.   The scars to her cheek and around her swollen eyes are reportedly clearly visible and may be permanent.  The left side of Tyah’s face is numb and she can only achieve a half-smile.  It is reported Tyah’s head must be wrapped in gauze as there is no skin beneath it.   Surgery is scheduled for October 19 where doctors will harvest skin from Tyah’s thigh and use it to repair her head.  She will likely need 3 – 4 more surgeries in the next 6 months.

 

How did this happen?  Tyah says that a girl 4 years older than her invited Tyah into her yard.  The yard was enclosed by a 6-foot wooden privacy fence.  Inside the yard is where the attack occurred.  The dogs were owned by the homeowners and have since been euthanized.  The owners are being charged with a felony for keeping a dangerous animal that caused serious injury. The owners of the dogs claim that the dogs were not previously violent and that they cautioned the 6-year-old about going in the yard. 

 

Michigan is a strict liability state in regards to dog bites, meaning a dog is not allowed “one free bite” as in some other states. No matter whether the dog has shown aggressive behavior in the past or if it has already bitten someone before, the dog owner may be held liable for the victim’s injuries. The only exception would usually be if the victim was trespassing or provoked the dog in some manner.

  Another Pit Bull Attack in Dearborn Heights

Unbelievable.  After blogging on Friday about a pit bull attack in Dearborn Heights, another attack occurred in Dearborn Heights over the weekend.  At approximately 7:45 p.m. on Saturday, a 10-year-old girl was playing on the sidewalk on Colgate Street .  From out of nowhere, a pit bull ran from a backyard and viciously attacked the girl.  Lucky for the little girl, Gerald LaMonica, 75, was on a walk and saw the entire attack.  He ran across the street yelling at the dog and reportedly kicked the dog in the chest to get it off of her.  While LaMonica was successful, the dog then turned and attacked him.  The attack left the girl with 14 stitches in her arm and leg.  LaMonica required 15 stitches to his leg and is also having back pain after kicking the dog.  The dog is currently in quarantine pending further investigation by the police.

  Pit Bulls Attack Woman As She Is Gardening

Yet another horrific story of a dog attack!  Yesterday, a Dearborn Heights woman was in her own backyard gardening when she was attacked by 2 pit bulls.  The severely injured woman was reportedly bitten all over and required hospitalization for treatment of her injuries.

  2-Year-Old Falls From 9th-Floor Apartment Building

A 2-year-old girl suffered a broken femur when she fell from a 9th story window at the North Park Place apartment complex in Southfield.  Investigators believe that the girl may have been reaching for a sippy cup on the window sill and went through the screen.  At this time, investigators do not believe a faulty screen played a role in the fall however, neighbors are questioning the strength of the screen and other falls have occurred at the apartment complex.  It is being reported that a 16-month-old died in 2006 after falling from a 14th floor window.  Apparently, Southfield city officials intend to form a task force to work with apartment management to prevent similar falls from occurring in the future.

  Dog Attack In Waterford Township

Two dog attacks have been reported in Waterford Township since Sunday.  The first involved a pit bull attack upon a neighboring Yorkshire terrier.  It is being reported that the terrier was in its fenced yard when the pit bull forced its way under the fence.  The owner of the Yorkshire terrier picked it up but the pit bull leaped up and bit the head of the terrier.  The pit bull reportedly would not release until its owner jumped over the fence and forced it to release the smaller dog. 

 

The second attack is even more frightening.  On Tuesday, a 4-day-old infant was on his grandfather’s lap with when he was bit in the head by his father’s dog.  The pit bull mix was reportedly at the grandfather’s feet when, without warning or provocation, the dog got up and bit the newborn.  The baby was taken to a local hospital where he was hospitalized for a head laceration.  The dog has been turned over to Oakland County Animal Control where it will be destroyed with the dog owner’s permission.

  Three Pit Bulls Attack 6-Year-Old

On Tuesday afternoon, 6-year-old Tyah Norris was playing with a friend when she was attacked by three pit bulls.  One of the dogs knocked the girl down and, together with the other two dogs, viciously attacked the girl.  The injuries to the little girl were serious enough to require her to be airlifted to Mott Children’s Hospital in Ann Arbor where she remains in serious condition.  It is being reported that the owner of the dogs have given permission to authorities to euthanize the dogs.
