You may have seen the shocking video on the news. William Geary, 60, was stopped at a red light waiting to make a left turn. While he was properly stopped, Mr. Geary reportedly saw a semi-truck, that appeared to be traveling fast, beginning to make a right turn. He saw the driver leaning forward and looking in his side mirror. Then he saw panic in the driver's face. The second trailer from the driver's trailer tipped over onto Mr. Geary's truck crushing him beneath. Police tried unsuccessfully to move the trailer with two separate tow truck but eventually needed a large forklift to pull Mr. Geary's pickup, with him inside, from beneath the semi trailer.
Mr. Geary was trapped under that truck for 90 minutes, awake and conscious. His left knee and left wrist were crushed. His neck was broken. A passerby sat in the back seat and held his head and neck in place during the ordeal. Since the crash, Mr. Geary endured four surgeries and is expected to have multiple surgeries on his neck in the future. He has at least $250,000 in medical bills and is no longer able to work. He needs a walker to ambulate, has panic attacks and is in constant pain.
The driver of the semi was cited for careless driving and making an improper right turn involving a crash. There have also been allegations that the rear trailer axle brakes were out of adjustment and had mismatched brake slack adjusters that make sure the brakes continue to work as they wear out.
This appears to be a clear cut situation that should have been settled out of court. Mr. Geary was properly sitting at a red light. There is absolutely nothing that he did wrong. The driver employed by the trucking company was completely at fault. Yet the trucking company refuses to settle the case and forces Mr. Geary to file suit. Outrageous.
