  Birth Defect versus Birth Injury

When couples are expecting the birth of their child, the last thing they want to think about is the fact that their infant may be injured.  Unfortunately, a significant percentage of births result in newborns being injured.  Anytime infants suffer injuries during the labor and/or delivery process, the injuries are referred to as "birth injuries".

Parents who think that their children may have suffered birth injuries must first understand the difference between a "birth defect" and a "birth injury".  When a child has a birth defect, he/she did not suffer any harm during the labor and/or delivery process.  Instead, the child may have a genetic defect or may have incurred damage during the pregnancy.

Children who suffer birth injuries are usually victims of medical malpractice.  This means that during the labor and/or delivery process, medical professionals acted negligently and compromised the physical health of the children who are injured.  In these cases, parents may have the right to take legal action against medical professionals for their negligence.

Did you child suffer a birth injury in Detroit?  If so, please contact Freedman & Freedman to speak with a Detroit personal injury lawyer today.
