Drunk Driver Kills Teacher, Prosecutor Seeks Second-Degree Murder

Testimony began Tuesday in the criminal trial of Leonel Franco-Avina for the death of 30-year-old Aaron Haynes last November 23rd. Franco-Avina allegedly had a blood alcohol content of 0.425 when he drove the wrong way on the northbound lanes of East Beltline Avenue and hit Haynes head-on. At the time of thecar accident, Franco-Avina's alleged blood alcohol was more than 4 times the legal limit prompting the prosecutor's argument that Franco-Avina be convicted second-degree murder, not drunken driving causing death.
